These disclosures are intended to help you understand how the Service works, its limitations, and your responsibilities when using DMS.cx.
These disclosures form part of your overall understanding of the Service and should be read together with the Terms of Service and Privacy Policy.
1. Nature of the Service
DMS.cx is a digital platform that allows users to:
- store encrypted or protected materials;
- configure reminder and check-in systems;
- designate verifiers, recipients, and beneficiaries; and
- create conditional workflows for the release of information.
The Service is designed as a technical coordination tool only.
DMS.cx does not:
- verify death, incapacity, or legal status;
- make legal determinations; or
- execute legally binding transfers of assets or rights.
2. Not a Legal or Estate Instrument
DMS.cx is not:
- a will, trust, or testamentary document;
- a substitute for estate planning;
- a legal, financial, or fiduciary service; or
- a mechanism that transfers ownership or legal rights.
You are solely responsible for ensuring that your legal affairs are properly documented through qualified professionals.
Use of the Service should be considered supplementary only.
3. Encrypted Content Clarification
DMS.cx is designed so that certain user content may be encrypted prior to storage.
However:
- encryption depends on the actual system configuration in use;
- operational data may still be processed by the Company; and
- no system can guarantee absolute confidentiality or security.
Statements such as “encrypted,” “secure,” or “private” refer to intended design goals and not absolute guarantees.
4. Operational Data Transparency
Even when encrypted content is used, the Service must process certain operational information, including:
- account email and username;
- verifier and beneficiary contact details;
- workflow settings and schedules;
- system logs and activity records; and
- billing and transaction data.
This information is necessary for the Service to function.
5. Risk Acknowledgment
By using the Service, you acknowledge and accept that:
- notifications or reminders may fail or be delayed;
- email delivery may be blocked, filtered, or unsuccessful;
- verifiers may respond incorrectly, dishonestly, or not at all;
- workflows may execute incorrectly, late, or not at all;
- outdated or incorrect contact information may prevent delivery; and
- system outages or third-party failures may occur.
You further acknowledge that:
- the Service does not independently verify death, incapacity, or entitlement; and
- you are responsible for validating your own setup.
6. Encryption and Access Risks
You are solely responsible for maintaining:
- passwords;
- encryption keys;
- recovery methods; and
- any required access credentials.
Loss of such information may result in permanent and irreversible loss of access to your encrypted content.
DMS.cx cannot recover encrypted materials without required credentials.
7. Verifier Role Disclosure
Verifiers are selected by you.
DMS.cx:
- does not verify their identity;
- does not assess their judgment or reliability; and
- does not control their actions.
Verifier responses may directly affect release workflows.
Verifiers should understand that:
- they are not making legal determinations;
- their role is limited to responding to system prompts; and
- inaccurate responses may trigger unintended outcomes.
8. Beneficiary and Recipient Disclosure
Recipients and beneficiaries should understand that:
- receiving content does not establish legal entitlement;
- additional steps may be required to access or use released materials;
- DMS.cx does not validate rights to assets or accounts; and
- legal or financial advice may be required before acting on received information.
9. User Responsibility
You are solely responsible for:
- selecting trustworthy verifiers and recipients;
- maintaining accurate and current contact information;
- properly configuring workflows;
- safeguarding credentials and recovery methods; and
- testing the system before relying on it.
Failure to do so may result in unintended outcomes.
10. Recommended Use Practices
Users are strongly encouraged to:
- test all workflows before relying on them;
- maintain backup instructions outside the platform;
- coordinate use of DMS.cx with formal legal documents; and
- periodically review and update their configurations.
11. Acknowledgment
By using the Service, you acknowledge that:
- you understand the limitations described above;
- you accept the risks associated with automated workflows and digital systems; and
- you are using the Service at your own discretion and responsibility.
